UPON hearing the counsel, the Court made the following O R D E R
SLP (C) No. 5829/2024
The order presently under challenge, arising out of pure civil proceedings, has been passed by the High Court of Delhi. The main subject matter of dispute here i.e., land has admittedly been sold by the petitioner to a third party, and the cause of action itself does not survive as it is being stated here by the respondents. Even otherwise, we see absolutely no reason to interfere with the impugned order, in exercise of our jurisdiction under Article 136 of the Constitution of India. The Special Leave Petition is, accordingly, dismissed.
We give liberty to the respondents to move an appropriate application before the High Court or the court concerned.
Pending interlocutory application(s), if any, is/are disposed of.
Diary No. 22930/2024
Delay condoned.
In view of the order passed in SLP (C) No. 5829/2024 the present special leave petition has become infructuous.
The special leave petition is dismissed as infructuous.
