O R D E R

Learned senior counsel appearing for the Official Liquidator states that these are the cases where the applicants/petitioners were not employees but all of them had given undertakings in terms of order dated 26.02.2024 passed by this Court in Civil Appeal No.3184 of 2024.

The undertakings are taken on record.

If the applicants/petitioners do not succeed in their bid in respect of the respective premises occupied by them, they will have to vacate the same within a period of 15 days from the date of conclusion of the auction and hand over vacant possession of their respective premises to the Liquidator.

We also make it clear that if they do not participate in the auction, they shall vacate the premises occupied by them within a period of 15 days from the last date fixed for offering bids and hand over vacant possession of their respective premises to the Liquidator.

We also clarify that the applicants/petitioners who have given undertaking must pay occupancy charges at the rates at which they have been paying the same to the Liquidator, who will accept the same without prejudice to his rights and contentions. We make it clear that payment of charges will not create any right or equity in favour of the occupants.

We also direct that those who have given undertakings must pay arrears of occupancy charges as of today within a period of two months from the Liquidator.

The miscellaneous applications/special leave
