UPON hearing counsel the Court made the following O R D E R

Arguments in some of these cases were heard in 2011 and again in 2012.

When the cases were listed for further hearing on 23.2.2012 the Court was already busy in other part-heard matters. Therefore, a direction was issued that these cases will be taken up after conclusion of hearing of other matters. However, the Registry misinterpreted that order and did not list the case for almost 10 months.

On a mention made by Shri Ravi Kumar Tomar, learned counsel for the respondent(s), the cases were ordered to be listed on 12.12.2012.

In the pre-lunch session, learned senior counsel appearing for some of the manufacturers of Gutka and Pan Masala made a grievance that they had no intimation about listing of the cases and made a request for adjournment. In response to the query made by the Court, learned counsel informed us that the counsel who made a mention did not inform them about listing of the cases today.

Learned counsel appearing for both the sides gave out that further hearing of these matters is likely to take at least two to three days.

In view of the above, we direct that this and all connected matters including those filed in public interest be listed for further hearing on 12th February, 2013. If the hearing is not concluded on that day, the cases are likely to be taken up on the next day.

I.A. No.48 of 2012 in SLP(C) No.16308 of 2007 The application is dismissed because the issue raised therein has no connection with the subject matter of the main petition.
