Learned counsel for the respondents submits that in terms of the Assignment Agreement executed between IFCI Limited as Assignor and Prudent ARC Limited as Assignee, the debts in question have been assigned to the Assignee. This fact was mentioned in Agreement Annexure R1/A to the counter affidavit. However, the appellant has not impleaded/substituted the Assignee in place of the respondent(s).

Learned counsel for the appellant to do the needful within four weeks.

We may notice that respondent Nos. 2 to 5 are stated to be formal parties.

List before the Registrar concerned for completion of service.

Thereafter the matter may be placed before the Court.
