O R D E R
We have heard learned counsel for the parties.
There is a dispute whether the petitioners at all submitted the requisite documents before the cut-off date. As per the respondents it is not so.
The case of the petitioners is that they endeavoured to physically deliver documents which were not acknowledged and then they were sent by speed post. If that be so, naturally they would be required to have acknowledgment of the documents sent through speed post.
We are of the view that the aforesaid cannot be the subject matter of contempt proceedings. However, before closing the proceedings, we are of the view that if the documents have been sent in terms of our order by the specified date to the specified authority, we leave it to the 10 left out persons who have now alleged contempt to bring it to the notice of the concerned authority the proof of such receipt of documents by them. In that eventuality the respondents to examine their case for the said purpose.
The proof, if any, be sent within a week and examination to take place within a maximum period of three weeks thereafter.
2
With the aforesaid the contempt proceedings are closed and the contempt petitions are disposed of accordingly.
