UPON hearing the counsel the court made the following O R D E R

  1. Mr. Siddharth Dave, learned Senior counsel appearing for the petitioners draws the attention of this Court to the order passed on 22nd

September, 2023 and states that as on date, the respondents are in

default to the tune of 1.25 million US $.

  1. The afore-said statement is disputed by Mr. Abhinav Sharma, learned counsel appearing for the respondents who states that amounts have been paid, though belatedly.

  2. The very fact that the respondents are in default, is apparent from the deadlines pointed out by learned counsel for the parties. There is no scope of any belated payment being made by the respondents in the instant case and the petitioner is quite justified in stating that amounts due have not been paid fully.

  3. The respondents shall ensure that the outstanding amounts are paid by the next date of hearing. The next instalment that is due in the month of March, 2024, shall be cleared on or before 15th March, 2024, failing which the exemption from appearance granted to the alleged contemnors/respondents No.1 and 2 shall stand automatically recalled.

  4. List on 22nd March, 2024, high up on the Board.
