UPON hearing the counsel the Court made the following O R D E R

1 This batch of petitions arose from an order of a Division Bench of the High Court of Judicature at Bombay dated 2 February 2021, denying interim relief to the petitioners who are students who suffer from physical disabilities.

  • 2 The students appeared at the NEET PG examination and are desirous of securing admission to post graduate courses.
  • 3 While entertaining the Special Leave Petitions, this Court had directed that the provisional allotment of seats to the three petitioners in these proceedings shall not be disturbed pending further orders.
  • 4 Since the petitions under Article 226 of the Constitution are pending before the High Court, we direct that the interim orders which were passed in these proceedings shall continue to remain in operation till the High Court takes up the petitions for hearing and final disposal and pending the final disposal. The rights and contentions of the parties are kept open to be urged at the hearing of the petitions.
  • 5 The ad–interim orders shall accordingly stand confirmed as interim orders pending the disposal of the writ petitions before the High Court. We permit the parties to move the High Court for expeditious hearing of the writ petitions.
  • 6 The Special Leave Petitions shall accordingly stand disposed of.
  • 7 Pending applications, if any, stand disposed of.
