O R D E R

We have heard learned counsel appearing on behalf of both the parties.

Our attention has been drawn to the Settlement Terms of 15.01.2013 and to clause 14.3 in particular, which states that as long as any amounts are due and payable, the IL&FS Group alone will continue to have majority control over MPL and its subsidiaries. A Consent Decree dated 26.07.2014 reflects these Terms. In addition, what has been pointed out to us is that, as of date, the admitted amount of the revised claim is Rs.4,437,500,000. This being the case, we direct the National Company Law Appellate Tribunal to take up this matter on 07.02.2020, when it is listed and dispose of the same either on that day or on any convenient date so that the the matter stands disposed of before the end of February, 2020.

The civil appeal stands disposed of.
