UPON hearing the counsel the Court made the following O R D E R
1 In the facts and circumstances of the present case, since the caste status of the respondent was validated and she has been found to belong to a Scheduled Caste, the order of the High Court granting 50% back wages, together with consequential benefits, including by way of promotion, as envisaged by the High Court, does not call for interference. - 2 Mr Jamshed Cama, learned Senior Counsel appearing on behalf of the petitioners, submits that the issue as to the entitlement of the respondent to promotion may be heard by this Court so as to bring clarity in the matter for future cases.
- 3 In the facts of this case, we are not inclined to entertain the Special Leave Petition under Article 136 of the Constitution for the reasons recorded in para 1 above leaving it open to be considered in an appropriate case in future.
- 4 The Special Leave Petition is dismissed.
