1 <sup>st</sup> respondent filed counter-<br>The | |||
affidavit contending that subsequent to the | |||
orders passed by this Court in W.P.No.3449 | |||
of 2022, the petitioner requested the 3 <sup>rd</sup> | |||
respondent- VC & MD, APSCCFC Ltd., | |||
Tadepalli for compliance of the orders, | |||
through letter dated 08.05.2023. Pursuantly, | |||
3 <sup>rd</sup><br>the<br>respondent sent due payment | |||
this<br>respondent<br>vide<br>proposal<br>to | |||
Rc.No.LC/940/APSC/2023, dated 25.05.2023 | |||
and this respondent sent the due payment | |||
proposal to the Finance<br>(FMU.WEL.I) | |||
Department with a request to release the | |||
amount for clearance of pending<br>bills | contd |
payable to the petitioner. The issue is pending with the Finance Department, over which this respondent will not have any control. The 1st respondent, in obedience to the orders of this Court, had done her duty within her control. Thus, there is no disobedience to the orders of this Court as alleged by the petitioner. Hence, prayed to exonerate her from this Contempt Case.

The material filed along with the counter filed by the 1st respondent makes it clear that the 1st respondent has forwarded the due payment proposal sent to her by the 3 rd respondent and now the issue is pending with the Finance Department, the functions of which are beyond the control of the 1st respondent. In view of the same, the 1st respondent is exonerated for the time being leaving it open to the petitioner to file memo seeking to proceed against her in future, if necessity arises.
Considering the contents of the counter-affidavit filed by the 1st respondent, the 1st respondent is exonerated from this Contempt Case for the time being.
Admit against respondent Nos.2 to 4. Post on 10.11.2023.
