Heard.

In view of the order proposed, issuance of notices to private opposite parties is hereby dispensed with.

The present petition has been filed for the following main relief:-

"(a) Direct the opposite party no. 1 i.e. Up-Ziladhikari, Tehsil and District Amethi to decide the Appeal No. T202204710505257, under Section 35(2) of U.P. Revenue Code, 2006, namely Hausila Prasad Versus Rajkali, relating to Village Ramgarh, Pargana, Tehsil and District Amethi, expeditiously within a period as fixed by this Hon'ble Court, in the interest of justice."

Learned counsel for the petitioner stated that justice would suffice if a direction is issued to the opposite party no.1, to decide the Appeal No. T202204710505257 as according to Section 183(4) of U.P. Revenue Code, 2016, a revision or appeal should be decided preferably within six months and the appeal is issue is pending since October 2022.

The aforesaid prayer has not been disputed by the learned counsel for the side opposite party.

Considering the aforesaid, the present petition is disposed of with the direction to the opposite party no. 1 to consider and decide the Appeal No. T202204710505257 within the six months as provided under Section 183(4) of U.P. Revenue Code, 2016, if there is no other legal impediment in this regard. In concluding the proceedings of the case, the authority concerned shall avoid unnecessary adjournments to the parties to the litigation.

It is made clear that the Court has not examined the case of either of the parties on merits and the authority concerned shall be free to decide the matter strictly in accordance with law.

With the aforesaid, the petition is disposed of.
