1. Sri Diwakar Pratap Pandey, learned counsel appearing for the petitioner submits that present writ petition has been filed seeking a direction to Sub Divisional Magistrate, Ambedkar Nagar to consider and decide his application for grant of fair price shop license on the ground that previous licensee was his grandmother and he is also entitled to be granted license on the death of his grandmother according to the government order dated 5th August, 2019.

2. Before this matter could be heard it has been informed that respondent No.2 has already passed order rejecting his application and, hence, learned counsel for the petitioner submits that he may be permitted to withdraw this petition and file afresh assailing the order of rejection.

3. In light of the above, the petition is dismissed as withdrawn with liberty to file fresh petition assailing the order of rejection.
