Court No. - 44

Case :- CRIMINAL REVISION No. - 2140 of 2018

Revisionist :- Smt. Sitabi Devi Opposite Party :- State Of U.P. And 3 Others Counsel for Revisionist :- Shivam Yadav,Akhilesh Singh Counsel for Opposite Party :- G.A.

Hon'ble Ramesh Sinha,J.

Heard Sri Shivam Yadav, learned counsel for the revisionist and Sri Irshad Husain learned A.G.A for the State.

The revisionist by means of this revision has challenged the order dated 06.04.2018 passed by the Additional Sessions Judge-IV, Maharajganj, in complaint case no. 31 of 2018, under section 156 (3) Cr.P.C, police station Pharenda, District Mainpuri.

Learned counsel for the revisionist submitted that revisionist is the complainant in the present case. He further submitted that some attrocities were committed by the police persons who are respondent nos. 2 to 4 against the revisionist. The revisionist moved an application under section 156 (3) Cr.P.C for lodging F.I.R before the court concerned which was rejected by the court concerned without application of mind, hence the impugned order be set aside.

After having heard the learned counsel for the parties present and perused the impugned order as well as the material brought on record. I am of the view that the impugned order does not suffer from any irregularity, illegality or jurisdictional error, hence no interference is required by this Court. The prayer for quashing the impugned order is refused.

This revision lacks merits and is accordingly dismissed.
