In pursuance to the previous order passed by this Court, the Standing Counsel has received instructions and has handed over a copy of the same to the Court, which is taken on record.

On the basis of his instructions, the Standing Counsel states that the proceedings have been instituted against respondent Nos. 10 to 17 for recovery of the amount disbursed to them under the Pradhan Mantri Avas Yojna and notices to that effect have already been issued.

The Standing Counsel has drawn the attention of the Court to the order dated 4.8.2021 passed by the Block Development Officer, Reoti, Ballia, which records the fact that certain constructions have already been made over the disputed plots.

Issue notice to respondent Nos. 10 to 17 through registered post with acknowledgement due for which steps shall be taken by counsel for the petitioners within 10 days from today.

If, steps are taken, office shall proceed to issue notice fixing any date after eight weeks by which date, the respondents may file their counter affidavit. The petitioner shall have four weeks thereafter to file their rejoinder affidavit.

List after expiry of the aforesaid period.

Meanwhile, any constructions made over the disputed plots shall be subject to the decision of the present writ petition.

It is also clarified that the District Administration shall be at liberty to continue the proceedings instituted through notices issued to the respondents.
