Heard learned counsel for the parties.

Submission of learned counsel for the petitioner is that the petitioner applied for the post of Assistant Teacher L.T. Grade (Art) and he was given 135.95 quality point marks. He further submitted that Uttarakhand Technical Education Board, Roorkee declared the result of on 23.08.2011 in which name of selected candidates was given. In that order cut of marks of the selected candidates and their category have also been given. In that order cut of marks for general category has been shown as 134.64.

Learned counsel for the petitioner submitted that since the petitioner has secured more marks than last selected candidate, the petitioner is entitled for appointment. He prayed that direction be issued to the Uttarakhand Technical Education Board to include the name of the petitioner in the select list dated 23.08.2011.

After considering the submissions of learned counsel for the parties, I direct the respondents either to include the name of the petitioner in the select list within a period of six weeks from the date of production of certified copy of the order or show cause by way of filing counter affidavit.
