no.3.<br>On<br>the<br>last<br>date,<br>learned<br>State<br>counsel was directed to seek detailed
instructions in the matter. Today, on<br>instructions,<br>learned<br>State<br>counsel<br>states<br>that<br>there<br>were<br>no<br>physical<br>injuries<br>on the body of the deceased.
Learned petitioners' counsel<br>would<br>that in the case of Kuldeep<br>submit
Goyal<br>vs.<br>State<br>of<br>Uttarakhand,<br>reported in 2013 (1) U.D., 612, this<br>Hon'ble Court has held that in view of
the dictum of Hon'ble Apex Court in the<br>case of Joginder Kumar vs. State of<br>U.P., reported in 1994 (4) SCC 260,
in which, Hon'ble Apex Court has held<br>that<br>simply<br>because<br>accusation<br>is<br>made, accused should not be arrested
for<br>the<br>offence<br>punishable<br>under<br>Section 304-B IPC, if postmortem does
not<br>suggest<br>burn<br>injuries<br>or<br>bodily<br>injuries and cause of death could not be<br>ascertained<br>during<br>post<br>mortem
examination, the arrest can be kept in<br>abeyance till viscera report is received
suggesting poisoning. Police should not<br>act<br>in<br>haste<br>and<br>to<br>play<br>with<br>the<br>personal liberty of citizen in violation of<br>Article<br>21 of the Constitution of India.<br>In view of the above, it is directed<br>as an interim measure that no coercive<br>measures shall be adopted against the<br>petitioners<br>in<br>connection<br>with<br>the<br>impugned<br>FIR,<br>subject<br>to<br>their<br>cooperation with the investigation,<br>till<br>the next date of<br>listing.<br>List<br>after<br>service<br>report<br>is<br>received.
