HON'BLE MR. JUSTICE T. AMARNATH GOUD
ORDER
29.03.2022
Heard Mr. B. Majumder, learned ASG appearing for the applicant.
[2] The present interlocutory application is filed before this court seeking extension of time by further three months for complying order dated 29.11.2021 passed by this court in CRP 81 of 2021.
[3] In the accompanying affidavit filed in support of this prayer, the deponent Mr. Chalhming Thanga who is the Joint Director (Administration) in the office of the Headquarter Project Pushpak, C/o 99APO, Mizoram has indicated that presently the file containing the order dated 29.11.2021 for compliance is in the office of LA Section Branch, Kolkata, Ministry of Law & Justice for advice for further taking appropriate decision by Department.
[4] In this context, Mr. Majumder, learned ASG represents before this court that he had sensitized his clients with regard to compliance of the order dated 29.11.2021. He further apprised this court that he has been instructed by his clients that now if three months extension of time is granted, they will certainly comply with the order dated 29.11.2021 passed in CRP No.81 of 2021.
[5] Firstly, it is apparent from this records that at the time of disposing the present CRP 81 of 2021 by the order dated 29.11.2021, this court has granted four weeks time as per the representation made by the LA Collector who was present before this court. Secondly, an interlocutory application being IA 03 of 2021 in CRP 81 of 2021 seeking extension of time was filed on 23.12.2021. The applicant for the third time has filed again an interlocutory application being IA 04 of 2022 in CRP 81 of 2021 seeking extension of time for another three months.
[6] In view of the above reasons and keeping in mind with regard to administrative exigencies in the government departments, this court once again accedes to the request made by the applicant herein seeking extension of time from today and grants three months time as prayed for i.e. upto 27.06.2022.
[7] This court makes it clear that in future no extension of time will be considered on any pretext. Further, it is also made clear that in the event if the orders of this court are not complied with by 27.06.2022, the counsel appearing for the claimants are at liberty to initiate steps to file appropriate application for willful disobedience of the orders passed by this court under Contempt of Courts Act.
[8] With the above observation the extension of time petition stands allowed and disposed of.
