IA No. 52077/2025 - CONDONATION OF DELAY IN FILING IA No. 52080/2025 - CONDONATION OF DELAY IN REFILING / CURING THE DEFECTS, IA No. 52075/2025 - EXEMPTION FROM FILING O.T.

Date : 03-03-2025 This matter was called on for hearing today.

CORAM : HON'BLE MR. JUSTICE SUDHANSHU DHULIA HON'BLE MR. JUSTICE K. VINOD CHANDRAN

For Petitioner(s) : Mr. S. Vinay Ratnakar, AOR Mr. Sunit Kumar Toppo, Adv. Mr. Alok Raj, Adv.

For Respondent(s) :

UPON hearing the counsel the Court made the following O R D E R

Delay condoned.

The petitioner is seeking regularisation in service. The order passed by the learned Single Judge in his favour has been set aside by the Division Bench of the High Court.

After having heard learned counsel for the petitioner, we find that the order passed by the Division Bench is a well considered order giving reasons as to why the petitioner cannot be regularised for the simple reason that he was absent from duty for four years and thus, does not fulfil the condition of a Government circular Digitally signed by Jayant Kumar Arora Date: 2025.03.06 16:55:08 IST Reason: Signature Not Verified

dated 05.03.2008.

Under these circumstances, we see no reason to interfere in the matter since the applicability of the circular itself is in doubt and the reasons have been assigned by the Division Bench for the same.

The Special Leave Petition is, accordingly, dismissed.

Pending interlocutory application(s), if any, is/are disposed of.
