UPON hearing the counsel, the Court made the following O R D E R
At this interim stage, we deem it appropriate to direct the petitioner, Karnataka State Pollution Control Board1, to undertake an inspection of the unit of respondent No. 1, M/s. Siddhasiri Souharda Sahakari Niyamitha, within seven working days from today. The Central Pollution Control Board will nominate one of its officers to be associated with the task of the aforesaid inspection and will communicate with the petitioner, KSPCB in this regard.
In case, upon such inspection, it is found that respondent No. 1, M/s. Siddhasiri Souharda Sahakari Niyamitha, is compliant with the conditions stipulated by the Expert Appraisal Committee, Ministry of Environment, Forest and Climate Change, Government of India, in its recommendation dated 09.11.2023 and the other prescribed parameters, as applicable for obtaining Consent for Operation (CFO), a provisional CFO will be issued to it.
In case, respondent No. 1, M/s. Siddhasiri Souharda Sahakari Niyamitha, is found non-compliant, the details thereof will be furnished to it forthwith for necessary compliance.
Re-list in the week commencing 24.02.2025.
