UPON hearing the counsel, the Court made the following ORDER
Signature Not Verified Learned senior counsel, appearing for respondent No.1 submits Hat its sugar manufacturing industry has not been in operation, and even today the production has not commenced.
Respondent No.1 will file an affidavit, duly affirmed by its Managing Director, clearly stating whether the industry was ever in operation on or after 01.01.2021. Details with regard to electricity consumption, electricity bills, and the purchases made shall be placed on record.
In case any secondary manufacturing activities, i.e., activity not relating to crushing of sugarcane and manufacture of sugar etc., have been undertaken, the details of the same will also be stated in the affidavit.
The said affidavit shall be filed within two weeks from today.
In the meanwhile, we also permit the petitioner, Karnataka State Pollution Control Board, to file an affidavit, in view of the report dated 30.08.2024. The said affidavit shall also be filed within two weeks from today.
Advance copy of the Special Leave Petition shall be furnished to the standing counsel/Central Agency as we require information/details from Respondent No.2, Ministry of Environment, Forest and Climate Change as to the grant of Environment Clearance to respondent No.1.
Re-list in the week commencing 30.09.2024.
