UPON hearing the counsel the Court made the following O R D E R
Obviously, the Committee which has passed the impugned orders is not a Court.
The learned senior counsel appearing for the petitioner seeks time to satisfy the Court that it is a Tribunal. He seeks time to produce on record the relevant orders under which the Committee has been constituted. The issue is of maintainability of Special Leave Petitions.
The petitioner will have to also deal with another preliminary objection. The learned senior counsel appearing for the respondent/caveator tenders on record a Resolution dated 23rd December, 2023 passed by the Municipal Corporation of Delhi.
2
As these Special Leave Petitions have been filed by the Municipal Commissioner, the learned senior counsel for the petitioner will have to satisfy the Court, assuming that these petitions are maintainable, under what authority the Municipal Commissioner has filed the present Special Leave Petitions.
List on 29th January, 2024.
