IN THE SUPREME COURT OF INDIA INHERENT JURISDICTION

REVIEW PETITION (C) Nos. $/2025$ [@ R.P.(C) Diary No(s). $48404/2024$ ]

$\mathbf{IN}$

SPECIAL LEAVE PETITION(C) No. 3978/2014

ROSHANI DEVI & ORS.

Petitioners

VERSUS

ST. STEPHENS HOSPITAL Respondent

O R D E R

$1.$ Delay condoned.

$\mathcal{L}$ Special Leave Petition(C) No. 3978 of 2014 was dismissed by this Court by an order dated August 14, 2024. The petitioners in the said special leave petition have now applied for a review of the order dated August 14, 2024.

We have considered the review petition as well as the order under $\mathbf{3}$ . review. The special leave petition was dismissed not only on the ground that the petitioners had accepted the decretal amount without reserving right to prefer an appeal but also on the ground that they had not disclosed in the special leave petition the fact of receipt of such decretal amount. The attempt made by the petitioners to overcome such non disclosure of a material fact by citing "inadvertent error" was not considered sufficient by this Court.

  1. In such view of the matter, the decisions referred to in the review petition which arise out of different sets of facts as well as under a different enactment (The Motor Vehicles Act, 1988) have no application. Thus, we are of the clear opinion that no case for review has been set up.

  2. The review petition is, therefore, dismissed.

  3. Pending application(s), if any, shall stand disposed of.
