UPON hearing the counsel the Court made the following O R D E R

I.A.No.186821/2024 In SLP(C)........D.No.39178/2022 and I.A.No.186837/20-24 in SLP(C)......D.No.39180/2022

1. Heard State Counsel in support of the prayer made in these applications. Learned Senior Counsel and other counsels for the respondent-land owners have also been heard.

2. Taking into consideration the totality of the circumstances, these applications are disposed of in the following terms:

(i) 50% of the enhanced compensation amount, as awarded by the High Court, be released to the landowners on their furnishing indemnity bond to the satisfaction of the Reference Court.

(ii) The petitioners are directed to deposit the remaining 50% of the enhanced compensation amount with the Reference Court within four weeks. The Reference Court shall deposit the said amount in a short term Fixed Deposit Receipt in a nationalized bank so that it can fetch maximum rate of interest.

3. This arrangement will continue till further orders.

4. Post the main matters for hearing on 22.10.2024.

5. Meanwhile, the unserved respondents be served through dasti process.
