UPON hearing the counsel the Court made the following O R D E R

I.A. D.NO. 58200 OF 2024:

This is an application moved by the Municipal Corporation of Greater Mumbai.

The case made out in the application is that the Municipal Corporation requires possession of structures occupied by 24 slum dwellers whose names appeared in Annexure R-5 for the purposes of doing the work of widening/re-alignment of the existing nallah.

All the 24 persons have given undertakings in terms of order dated 15.12.2023 to vacate the premises by 30.04.2024. It is not in dispute that all 24 persons have been held eligible for rehabilitation in the re-developed property.

The learned counsel appearing for the developer/respondent no.5 states that to all eligible slum dwellers who have vacated their premises, the developer is paying rent @ Rs.20,000/-p.m. to enable the persons concerned to acquire rented accommodation.

The developer shall pay rent in terms of Circular No.210 dated 01.08.2023 issued by the Slum Rehabilitation Authority as modified by Circular No.210-A to the 24 eligible persons whose names appear in Annexure R-5.

Needless to add that said persons shall vacate their respective premises on or before 30.04.2024.

If the said 24 persons do not vacate by 30.04.2024, we grant liberty to the Municipal Corporation to make appropriate application before this Court.

The application stands disposed of.
