UPON hearing the counsel, the Court made the following O R D E R
- 1 Issue notice, returnable on 29 July, 2024.
- 2 Dr. A.M. Singhvi, learned senior counsel, appearing for the petitioner in SLP (C) No. 12490 of 2024, would bring to our notice the amendment made in Section 70 of the Bihar Panchayat Raj Act, 2006, in the year 2015, which bars a second No Confidence Motion being brought during the tenure of the Adhyaksha or Upadhyaksha.
- 3 In the light of the aforestated amendment, we see no reason to grant interim relief at this stage in SLP (C) No 12490 of 2024.
- 4 As regards SLP (C) No. 12560 of 2024, the learned counsel appearing on caveat for Respondent No. 26 would inform this Court that the petitioner therein has already been displaced from office. If that is so, the matter, including the prayer for interim relief, would have to be examined on merits only after completion of the pleadings.
