UPON hearing the counsel the Court made the following O R D E R

Respondent nos.2 and 4 have already filed counter affidavit. Despite due service on respondent nos.1 and 3, there is no appearance.

Service is not complete in respect of respondent nos.5 and 6. However, Mr. Lakshay Dhamija, Ld. Counsel appearing for Mr. Sunar Rastogi, Ld. AOR submits that vakalatnama has been filed on behalf of respondent no.6 yesterday and no copy of the petition for filing the counter affidavit is available with him. Ld. Counsel for the petitioner submits that he shall make soft copy available today itself. Ld. Counsel for respondent no.6 seeks and is granted three weeks time to file the counter affidavit.

ITEM NO.18 REGISTRAR COURT. 2 SECTION XIV

Ld. Counsel for respondent no.6 submits that respondent no.5 have passed away and he shall handover a copy of the death certificate to Ld. Counsel for the petitioner for taking appropriate steps. Ld. Counsel for petitioner seeks two weeks time to take necessary steps in respect of deceased respondent no.5. Time as requested for is granted.
