Leave granted.

Pursuant to the last hearing, the learned Senior Advocate appearing for Nurturing Ideas for Design Private Limited has shown us a few options. We feel that Option No. 3 is not identical or similar to the trademark used by NIFD Institute of Fashion Design Limited1. Both marks are shown below:-

We are inclined to dispose of the present appeals recording that Nurturing Ideas for Design Private Limited will take steps and use the said abbreviation and mark, given as Option No. 3. Immediate changes which can be made to use the said abbreviation/ mark will be made. Where any legal formalities are required, steps in that regard will be taken within 45 days from today.

We, however, clarify that this order will not, in any way, affect the issues pending inter se the parties before the National Company Law Tribunal as well as the High Court of Punjab and Haryana at Chandigarh, wherein a challenge has also been made to the maintainability of the appeal.

The impugned order, which is an interim order, is accordingly clarified. The same will be read in terms of the present order. The appeals are disposed of in the above terms.

We also clarify that the observations made in this order will not be treated as findings on the merits of the disputes inter se the shareholders and the right of the minority shareholders to file a civil suit etc.

Pending application(s), if any, shall stand disposed of.
