UPON hearing the counsel the Court made the following O R D E R
Learned counsel for the respondents has shown us an order dated 27th February, 2017 passed in SLP(C) Nos.917-933 of 2017 (Association of Pvt. Dental and Medical Colleges of M.P. (APDMC) v. Union of India and Ors.). The order reads as follows:-
"Issue notice.
We are informed by learned counsel that the Central Government is considering the one-time relaxation for students who did not give the entrance examinations and have been admitted on the basis of 10+2 examination. We are also informed that this is an all India issue which involves students in fourteen States. In the circumstances, we consider it appropriate that the direction to remove the students from the rolls should be stayed till the Central Government takes a decision on the eligibility of such students. The Central Government shall take a decision within a period of six weeks from today. This consideration shall be without a reference to the orders of the High Court."
Learned counsel for the petitioner says that as per his information a decision has been taken by the Central Government pursuant to the order dated 27th February, 2017.
It is submitted by learned counsel for the respondents that the examinations are due to be held on 14th December, 2017.
In view thereof, we adjourn the matter to 8th December, 2017 so that there is some clarity on whether a decision has been taken by the Central Government or not.
On the oral request of learned counsel for the petitioner, Union of India through the Ministry of Health and Family Welfare is impleaded as a party respondent. Similarly, the Dental Council of India is also impleaded as a party respondent.
Amended memo of parties be filed within two days.
Issue dasti notice to the newly impleaded parties returnable on 8th December, 2017.
Notice may also be served on the Standing Counsel for the newly impleaded parties.
In view of the shortage of time, we have requested Mr. P.S. Narasimha, Additional Solicitor General, who is present in Court, to assist us in the matter.
IA No.63667/2017
