"Respondent no. 1 in C.A.No. 3676 and 3680 of 2015 has filed counter affidavit but after opportunity was declined to him. Learned counsel for the appellant to take fresh steps for effecting service of notice on respondent no. 3 in C.A.No. 3677 of 2015 within two weeks' time and notice thereafter, be issued. Registry to submit report regarding status of all the respondents in the next office report. List again on 12.01.2017."
It is submitted that Mr. Pukhrambam Ramesh Kumar, Advocate, has on 18.11.2016 filed counter affidavit on behalf of respondent Nos. 1 and 2 in Appeal No. 3679 of 2015 despite opportunity being declined vide order dated 25.07.2016 but he has not filed vakalatnama on behalf of the aforesaid respondents in this matter so far.
It is further submitted that fresh notice was issued on 22.12.2016 to respondent no. 3 in Civil Appeal No. 3677 of 2015 through Tribunal but Certificate of Service in respect of the said respondent is awaited from the Tribunal . However, Mr. D.S. Mahra, Advocate has filed vakalatnama on behalf of Govt. of India, Department of Telecommunications and the aforesaid unserved respondent no. 3 in Appeal no. 3677 of 2015 is "Wireless planning & Coordination wing, Department of Telecommunications, Ministry of Communications" but Mr. D.s. Mahra, Advocate has not specified if he is also representing the aforesaid respondent No. 3 in Appeal No. 3677 of 2015. Service is complete on rest of all the respondents.
