It is submitted for information of the Hon'ble Court that the Special Leave Petition abovementioned is filed against the Impugned Judgment and final Order dated 16th June, 2016 of the High Court of Karnataka at Bengaluru in ITA No. 191 of 2016 and is barred by time by 4 days. The Counsel for the Petitioner has filed Application for condonation of delay in filing Special Leave Petiton. Counsel for the petitioner has also filed application for condonation of delay in refiling the Special Leave Petition after curing the defects which is barred by time by 88 days.

It is further submitted for information of the Hon'ble Court that Civil Appeal No. 8509 of 2013 @ SLP (C) No. 19198 of 2012 entitled "COMMNR.OF INCOME TAXIII,BANGALORE & ANR vs TATA ELXSI LTD." arising out of relied upon judgment which was listed before the Hon'ble Court on 19th September, 2013, when the Hon'ble Court has granted leave. (Copy of the Order dated 19th September, 2013 is enclosed herewith for reference).

The matter alongwith applications abovementioned is listed before the Hon'ble Court with this Office Report.
