It is submitted for information of the Hon'ble Court that the Special Leave Petition abovementioned is filed against the impugned final Judgment and Order dated 28th June, 2016of the High Court of Karnataka at Bangalore in ITA No. 84 of 2013 and is barred by time by 86 days. The Counsel for the Petitioner has filed Application for condonation of delay in filing Special Leave Petiton.

It is further submitted for information of the Hon'ble Court that Civil Appeal No. 8509 of 2013 @ S.L.P.(C) No. 19198 of 2012 entitled "COMMNR.OF INCOME TAXIII,BANGALORE & ANR vs TATA ELXSI LTD." arising out of relied upon judgment which was listed before the Hon'ble Court on 19th September, 2013, when the Hon'ble Court has granted leave. (Copy of the Order dated 19th September, 2013 is enclosed herewith for reference).

It is also submitted for information of the Hon'ble Court that Civil Appeal No. 8509 of 2013 was also listed before the Hon'ble Court on 24th August, 2016 with group of matters (Main matter C.A. No. 8498 of 2013), when the Hon'ble Court has directed to list the matter in the month of February, 2017. (Copy of the Order dated 24th August, 2016 is enclosed herewith for reference).

The matter alongwith applications abovementioned is listed before the Hon'ble Court with this Office Report.
