January, 2015, when the Court was pleased to pass the following Order:

"Learned senior counsel for the petitioner states that the petitioner is ready and willing to pay, as a matter of discharge of all debts due to him, as also, by way of compensation a sum of Rs.50 lakhs to the respondents if the land taken by the respondents is returned to the petitioner.

Issue notice.

The respondents shall not create any encumbrance on the property in question, in the meantime."

Accordingly show cause notice was issued to all 5 respondents through registered A.D. post. Mr. Jogy Scaria, advocate has filed Vakalatnama/Appearance on behalf of all respondents but has not filed counteraffidavit so far.

Service of show cause notice is complete.

The matters abovementioned were listed before the Ld. Registrar on 07th

September, 2015, when he was pleased to pass the following Order:

"Respondents have failed to file the counter affidavit within the period stipulated under the rules. Viewed, in that context, the matter shall be processed for listing before the Hon'ble Court on its own turn."
