UPON hearing the counsel the Court made the following O R D E R
The petitioner who is a teacher in Political Science was transferred from Edapally to Akanad, both within the district of Ernakulam over a distance of barely 45 kms. We find that there is no reason to interfere with the order passed by the High Court rejecting the writ petition filed by the petitioner against the dismissal of her application by the Kerala Administrative Tribunal.
However, we note from the record that in its order dated 24 October 2019, the State Government has observed that the Director of General Education may furnish a proposal to give the petitioner a convenient posting in Ernakulam. This observation appears to have been made since the petitioner has been treated for a cancer.
Learned counsel appearing on behalf of the petitioner has stated that the petitioner is also due to retire on 31 March 2021.
In this background, we only observe that the circumstances relating to the petitioner may be duly borne in mind by the competent authority in considering her request for a more convenient posting. We, however, clarify that we are not interfering with the order of the transfer.
Subject to the above, the Special Leave Petition is disposed of.
Pending application, if any, stands disposed of.
