The Writ Petition above-mentioned was listed before the Hon'ble Court on
16.12.2015, when the Court was pleased to pass the following order:
"It is stated by learned counsel for the petitioner that a drought has been declared, if not in the entire State, at least in some Districts in the following States: Uttar Pradesh, Madhya Pradesh, Karnataka, Andhra Pradesh, Telangana, Maharashtra, Orissa and Jharkhand.
It is further stated by learned counsel that although a drought like situation exists in Gujrat, Haryana and Bihar, there is no declaration of a drought yet.
It is submitted by learned counsel that under the provisions of Section 3 of the National Food Security Act, 2013, every family is entitled to 5 kg. Of foodgrains per person per month. He says that in addition to the above, in the drought affected areas, provision should be made for supply of at least 2 kg of dal per person per month and provision of milk to the children under the Mid-Day Meal Scheme or at least one egg per day so that there should be adequate protein available to them.
Issue notice returnable on 4t h January, 2016.
Dasti, in addition, is permitted.
Service may also be effected through the Standing Counsel for the States and through the Central Agency for the Union of India."
It is submitted that pursuant to above Order, Show Cause Notice was issued to all the 12 respondents through Speed Post as well as Dasti on 18.12.2015.
It is further submitted that Mr. Nishant R. Katneshwarkar, Advocate has on 22.12.2015 filed Vakalatnama/appearance on behalf of State of Maharashtra (Respondent No. 7), however no Counter Affidavit has been filed, so far.
It is lastly submitted that Mr, Prashant Bhushan, Advocate for the Petitioner has on 22.12.2015 filed Affidavit with Proof of dasti service after serving Show Cause Notice upon all the respondents.
Hence, service of notice is complete.
The Writ Petition alongwith application above-mentioned is listed before the Hon'ble Court with this Office Report for Orders.
