SLP (C) No. 839 of 2016:-

It is submitted for the information of the Hon'ble Court that the instant matter has been filed against the Judgment and Order dated 07.10.2015 of the High Court of Sikkim at Gangtok in Writ Petition No. 06 of 2015 alongwith application for exemption from filing certified copy of Impugned Order (registered as I.A. No. 1-2. Counsel for the petitioner has also filed application for permission to bring on record the additional documents (registered as I.A. No. 2) and the same have been included in SLP paper books.

It is further submitted that Special Leave Petition(C) No. 18313 of 2012 arising out of similar issue was listed before the Hon'ble Court on 08.06.2012, when the Court was pleased to direct issue of notice. Copy of order dated 08.06.2012 has been placed as Annexure P-7 at Page Nos. 158 in SLP paper books.

It is further submitted that W.P. (C) No. 469 of 2014 arising out of similar issue was listed before the Hon'ble Court on 14.10.2014, when the Court was pleased to dispose of the same. Copy of order dated 14.10.2014 is enclosed herewith.

It is further submitted for the information of the Hon'ble Court that in view of undertaking letter dated Nil, counsel for the petitioner was required to file the copy of orders dated

25.09.2014, 13.07.2015 and 26.05.2015. He has on 12.01.2016 filed copy of orders dated 13.02.2015 and 26.05.2015 alongwith a letter dated 16.03.2016 stating therein that copy of order dated 25.09.2014 has already been filed as Annexure P-13 in the SLP and order dated 13.07.2015 has been wrongly mentioned in SLP and it is 13.02.2015 and the said Orders and letter dated 16.03.2016 have been been included in SLP Paper Books.

SLP (C) No. 1637 of 2016:-

It is submitted for the information of the Hon'ble Court that the instant matter has been filed against the Judgment and Order dated 07.10.2015 of the High Court of Sikkim at Gangtok in Writ Petition No. 12 of 2015 alongwith application for exemption from filing certified copy of Impugned Order (registered as I.A. No. 2) and condonation of Delay in refiling of SLP (barred by time by 2 days) and the delay has been condoned vide Additional Registrar (1B) order dated 16.01.2016 and SLP has been registered accordingly.

It is further submitted for the information of the Hon'ble Court that in view of undertaking letter dated 12.01.2016, counsel for the petitioner was required to file copy of orders dated 26.09.2011, 21.10.2011, 13.07.2015 and 26.05.2015. He has on 12.01.2016 filed copy of orders dated 13.02.2015 and 26.05.2015 alongwith a letter dated 16.03.2016 in main matter (SLP (C) No. 839 of 2016) stating therein that copy of order dated 25.09.2014 has already been filed as Annexure P-13 in the SLP and order dated 13.07.2015 has been wrongly mentioned in SLP and it is 13.02.2015 and the said Orders and letter dated 16.03.2016 have been been included in main SLP (C) No. 839 of 2016 Paper Books.

It is lastly submitted that both the matter are arising out of common Order and tagged together.

The matters alongwith applications above-mentioned are listed before the Hon'ble Court with this Office Report.
