By order dated 27.01.2023, this Court had directed the

petitioner herein to deposit a sum of Rs.2,40,000/- per month towards rent, until further orders. There was a further direction that the said sum shall not be withdrawn without leave of this Court.

Having heard learned counsel appearing for the respective parties, we dispose of this Special Leave Petition by making the aforesaid order dated 27.01.2023 absolute pending disposal of the suit. It is stated that the suit is at an advanced stage. In the circumstances, the Trial Court shall dispose of the suit within a period of three months from today or at any rate on or before 31.05.2025.

It is needless to observe that the aforesaid order passed by this Court, which is in the nature of an interim arrangement between the parties shall be subject to the result of the suit inasmuch as the suit will be considered on the basis of the evidence on record and on its on merits.

Further, at the time of disposal of the suit, the Trial Court shall bear in mind the amount deposited by the petitioner herein and pass orders regarding further deposit of arrears of rent, if any, and also pass an order with regard to withdrawal of the amount deposited by the petitioner herein before the Trial Court in accordance with law.

Ordered accordingly.

Pending application(s) shall stand disposed of.
