" Counter affidavit be filed within three weeks hence. Rejoinder affidavit, if any, be filed within one week therefrom. Interim protection passed by this Court on earlier occasion shall remain in force until further orders. Let the matter be listed on 21.04.2015."

It is submitted that the instant matter is an after notice matter. Show cause notice has been issued to both the respondents.

It is submitted that Ms. Hemantika Wahi, Advocate has filed Vakalatnama and Memo of Appearance and counter affidavit on behalf of both the respondents. Copy of the same has been included in the Special Leave petitions paper book.

It is submitted that counsel for the Petitioner has on 17.4.2015 filed Rejoinder affidavit.Copy of the same is being circulated for the kind perusal of the Hon'ble Court.

Service of show cause notice is complete.

The matter above mentioned alongwith connected matter as listed before the Hon'ble Court on 16.1.2015, when the Hon'ble Court was pleased to pass inter alia following order:

"

Issue notice returnable within four weeks. In addition, a copy of the petition be served on Ms. Hemantika Wahi, learned counsel who ordinarily appears for the State of Gujarat. Let the matter be listed on 16.03.2015. The name of Ms. Hemantika Wahi shall be reflected in the cause list on that day."

Accordingly show cause notice returnable on 16.3.2015 was issued to both the respondents through registered A.D.Post on 2.2.2015. A copy of the notice was also issued to Ms. Hemantika Wahi, standing counsel for State of Gujarat.

It is submitted that neither A.D. card nor unserved cover containing notice has been received back from any of the respondents so far.

It is submitted that pursuant to court's order quoted above, counsel for the petitioner has on 13.03.2015 filed proof of serving copy of petition on Ms. Hemantika Wahi, standing counsel for state of Gujarat but no one has entered appearance on behalf of Respondent no.1/State of Gujarat so far.

It is submitted that name of Ms. Hemantika Wahi,Advocate has been shown in the cause list for 16.3.2015.

Service of show cause notice is incomplete.

The matter above mentioned alongwith application is therefore listed before Hon'ble Court with this office report.
