UPON hearing the counsel the Court made the following O R D E R

Learned counsel for the petitioner says that an earlier Division Bench decision on the same subject was not noticed by the Division Bench in the impugned order, although the issue was specifically raised.

Learned counsel for the petitioner says that he will move a review application before the High Court.

In view of the above, learned counsel seeks leave to withdraw the petition with permission to file a review application, and later, if necessary, challenge the impugned judgment and order in this Court.

The application for permission to file SLP as also the special leave petition are dismissed as withdrawn with the aforesaid liberty.
