UPON hearing the counsel the Court made the following O R D E R Delay condoned.

Issue notice, returnable on 25.09.2023.

Learned Senior Counsel appearing for the petitioner raised only two issues: (i) The first is with respect to findings regarding transfer from one Agamic Temple to another Agamic Temple, which is required to be modified as each Temple is distinct and different having its own Customs, Usages and Practices; (ii) the second issue is with respect to the role required to be played by the appointing authority, especially in the absence of an elected trustee. On this issue, learned Senior Counsel submitted that after the expiry of the tenure of the trustees, and in case(s) where there is no elected trustee in existence, there is possibility of the executive officer/fit person taking on the role for longer period without making efforts to make further appointments.

Learned counsel for the respondent is required to give his response by way of an affidavit.
