The matter above mentioned was listed before the Hon'ble Court on

13.04.2015 with an office report dated 10.04.2015, when the Court was pleased to

pass the following Order:

"Prayer is allowed.

Rejoinder affidavit be filed within four weeks.

Learned counsel for the parties have invited our attention to the Motion Bench order dated 09.03.2015 depicting that respondent No.5 is the only contesting respondent. It is now pointed out that respondent No.1 is also a necessary party to the proceedings of this case. In the above view of the matter, let notice be issued to respondent No.1, returnable after four weeks. Service be effected upon respondent No.1 through its standing counsel in this Court. List thereafter."

It is submitted that counsel for the petitioner has not filed rejoinder affidavit,

so far.

It is further submitted that counsel for the respondent no. 5 has filed application for permission to file additional documents with Annexure A-1 which is registered as I.A. No. 2 and copy of the same is being circulated to the Hon'ble Court.

It is further submitted that fresh show cause notice, through standing counsel for the State of Madhya Pradesh, was issued to respondent no. 1 on 28.04.2015. A.D. card, duly signed, has been received from respondent no. 1 in regard to earlier show cause notice issued on 30.01.2015 but no one has entered appearance on his behalf.

It is lastly submitted that neither A.D. card nor unserved cover containing the notice has been received back from respondent nos. 2 to 4 . Service of show cause notice in respect of respondent nos. 2 to 4 is still awaited.

The matter above mentioned is listed before the Hon'ble Court with this Office Report.
