The matters above-mentioned were listed before the Hon'ble Court(In Chambers) on 25th November, 2016, when the Hon'ble Court was pleased to pass the following order :
"Last opportunity is granted to cure the defects pointed out in the office report within four weeks subject to payment of costs of Rs.5,000/- by the petitioner to be deposited in the Supreme Court Legal Services Committee within four weeks. The aforesaid amount shall be utilised for the juvenile justice issues."
It is submitted to the Hon'ble Court that Counsel for the Petitioner has on 5 th January, 2017 filed proof of deposit of Rs 5000/- on 16th December, 2016 at Supreme Court Legal Services Committee but has not cure the defects so far.
It is further that counsel for the Petitioner has still not filed application for substitution to bring on record the Lrs. of deceased Respondent Nos. 20, 73 , 88, 127, 134 and 191 so far despite this Registry's letter dated 8 th August, 2016. However, Mr. Anil Kumar Tandale, Advocate has on 23rd April, 2015 filed copies of death certificate of Respondent nos. 20, 73, 88, 127, 134 and 191 alongwith vakalatnama/appearance on behalf of lrs of deceased Respondent nos. 20, 73, 88, 127, 134 and 191.
It is further submitted that Counsel for the Petitioner has not taken fresh steps for the effecting service on Respondent Nos. 175 and 235.
It is also submitted that there are 235 common respondents in the matters. Mr. Anil Kumar Tandale, Advocate has entered appearance on behalf of respondent nos. 1 to 19, 21 to 72, 74 to 87, 89 to 126, 128 to 133, 135 to 174, 176 to 190 and 192 to 234 and also filed Counter Affidavit on their behalf.
Service is not complete.
The aforesaid default in the matter is listed before the Hon'ble Judge-in-chamber with this office report.
