OFFICE REPORT ON DEFAULT

The office report on default with regard to not curing the defects in Vakalatnama was listed before the Hon'ble Judge in Chamber on 27th September, 2016, when His Lordship was pleased to pass the following order:

"Two weeks' time is granted to learned counsel for the appellants to cure the defects in vakalatnama as pointed out by the Registry in its office report dated 26.08.2016."

It is submitted that Mrs. Sharmila Upadhyay, Advocate has on 13th January, 2014 filed Vakalatnama on behalf of Jaypee Cement Corporation Limited instead of Jaypee Gujarat Cement Plant on behalf of sole respondent in C.A. No. 5157 of 2013, but it is defective as name of firm given in vakalatnama does not tally with name of the firm given in cause – title. But neither counsel for the respondent has cured the defects in vakalatnama, nor an application for amendment of Cause Title has been filed despite this Registry's letter dated 30th September, 2016. Time granted by the Hon'ble Court has already expired.

The office report on default in the matters abovementioned is listed before the Hon'ble Judge in Chamber for orders.
