The matter above mentioned was listed before the Hon'ble Court on 21.01.2013, when the Court was pleased to pass the following order:

" Delay condoned. Issue notice. The operation of the impugned order passed by the High Court shall remain stayed in the meantime."

Accordingly, show cause notice to sole respondent was issued on 18.02.2013 through registered A.D. Post. An unserved cover containing notice with remarks 'Expired' has been received back.

It is submitted that Counsel for the petitioner has not filed any application for substitution to bring on record the LRs of deceased sole respondent despite various opportunities granted by the Ld. Registrar. The matter above mentioned was lastly listed before the Ld. Registrar's Court on 03.04.2014, when the following Order was passed:

" Ld.counsel for the petitioners is present. None for the respondent.

What gets revealed from the perusal of the office report is that although by order dated 17th January,2014 of this Court, the petitioner was given last chance for filing the substitution application to bring on

record the Lrs. of deceased sole respondent, yet he has not done the needful so far. Viewed in that context, the matter shall be processed for listing before the Hon'ble Judge in Chambers for further future directions. Await orders and list thereafter."

The matter is therefore listed before the Hon'ble Judge in Chambers with this office report on default for nonfiling of substitution application.
