It is submitted that Mr. Kamal Mohan Gupta, Advocate has filed Special Leave Petition on 18.10.2016 against the Judgment and Order dated 28.05.2016 of the High Court of Punjab and Haryana at Chandigarh in RFA Nos. 8327/14 etc etc alongwith application for permission to file Special Leave Petition.
It is further submitted that Counsel for petitioner has also filed an application for substitution to bring on record the Lrs of deceased petitioner viz Sher Singh which is barred by time by 209 days and Counsel has also filed an application for condonation of delay in filing substitution application alongwith prayer for setting aside abatement.
It is further submitted that Counsel for the petitioner has filed two applications for condonation of delay in filing the SLP and refiling the SLP (i) there is a delay of 50 days in filing the SLP against RFA Nos. 132630, 3103, 3591 of 2015, a delay of 36 in filing SLP against RFA Nos. 8327, 9049/2014 (ii) a delay of 103 days in refiling the SLP.
It is further submitted that SLP (C) No. 6057/2017 @ CC No. 3178/2017 Entitled RAM CHANDER vs STATE OF HARYANA AND ORS arising out of common order was listed before the Hon'ble Court on 13.02.2017, when the Hon'ble Court directed to issue of notice. SLP is pending after notice (Copy of order dated 13.02.2017 is enclosed herewith). (Main Matter SLP (C) No. 2539525397/2016).
It is further submitted that Mr. Kamal Mohan Gupta, Adv has on 01.04.2017 filed an application for permission to file additional documents alongwith annexure A1. Copies of the same are being circulated herewith.
The matter is listed before the Hon'ble Court with this office report.
