The writ petition above-mentioned was listed before the Hon'ble Court on 23.02.2017, when the Court was pleased to pass the following order:
"Issue notice, returnable in four weeks. The petitioners shall also serve notice on the standing counsel for the respective States."
It is submitted that pursuant to the aforesaid order, show cause notice was issued to all the four respondents through speed post on 06.03.2017. Notice has been delivered to all four respondents as per the tracking information of the postal authorities. Mr. Gopal Singh, Advocate has on 17.04.2017 filed vakalatnama/appearance on behalf of respondent no. 2 but he has not filed counter affidavit so far. No one has entered appearance on behalf of respondent nos. 1, 3 and 4 though served with notice.
It is further submitted that the counsel for the petitioner has on 03.04.2017 filed affidavit of dasti service along with proof of service after serving dasti notice upon all the respondents. The counsel has stated in the affidavit that respondent no. 3 – State of U.P. has refused to accept dasti notice hence the said respondent has been served by post. He has also filed proof of service after serving copy of the writ petition on the standing counsel for all four respondents.
Service of notice is complete.
