UPON hearing the counsel the Court made the following O R D E R Mr. Harish Salve, learned senior counsel has today given us a broad over view of the issues that fall for determination in these petitions. He has drawn our attention to the direction issued by this Court in Prakash Singh and Ors. Vs. Union of India and Ors. 2006 (8) SCC 1 and the purported compliance reported by the respondent-States of those directions. It was suggested by Mr. Salve that of all the issues that arise for examination the issues relating to separation of policing law and order from investigation could be picked up as the first issue for examination in the context of developments that have taken place since the pronouncement of the judgment aforementioned.
There was a broad consensus regarding that course of action. It was also suggested by Mr. Salve that constitutional validity of the Bihar Act could be first

examined with liberty to learned counsel for the other
States to intervene and make their submissions. We see no reason to decline that suggestion.
Most of the respondent-States have filed their counter affidavits to the Writ Petition 286 of 2013. Some of the States who have not done so can do the needful within six weeks. Rejoinder affidavit, if any, may be filed by the petitioner within two weeks thereafter.
We reserve liberty to the petitioner to file an application for transfer of certain writ petitions said to be pending before the High Court of Patna challenging the Bihar Act. In case any such applications are filed, the same be listed before an appropriate Bench for orders.
Post for final hearing on 03.11.2014 at 2 P.M. The Registry shall furnish to Mr. Salve, Amicus Curiae copies of the counter affidavits already filed by the State Government. Learned counsel appearing for the remaining respondent-State who may file their counter affidavit shall serve copies of such counter affidavits on Mr. Salve.
