O R D E R
On hearing learned counsel for the parties, it cannot be disputed that (i) the Next Below Rule which is the basis of the impugned judgment has been applied in certain other cases (ii) as also that the reply filed by the appellants in O.A. before the Central Administrative Tribunal was opined as inadequate by the High Court. It is however sought to be contended before us by learned counsel for the appellants that what has been done is contrary to the Rules.
We are of the view that in the given facts of the case as mentioned aforesaid, the impugned order does not call for any interference and thus the appeal is accordingly dismissed leaving the question of law open.
