UPON hearing the counsel the Court made the following O R D E R
- The present proceedings are in the nature of appeal against the order dated 13.09.2023 passed by the Registrar (Judicial Listing) lodging the Miscellaneous Application D. No. 34319 of 2023 seeking recall of order dated 13.07.2023 passed in Review Petition (c) No. 670 of 2023.
The applicant's / petitioner's Writ Petition under Article 2. 32 of the Constitution of India came to be dismissed by a ature Not Verified Digital Acceptation and Provided Acceptance on 27.03.2023. The applicant's / petitioner's <br>KAPIL TANDON <br>Digital 2028-4.01 review against the order dated 27.03.2023 was also dismissed on 13.07.2023. The applicant/petitioner has now filed the present Miscellaneous Application seeking recall of the order dated 13.07.2023.
3. By order dated 13.09.2023, the Registrar refused to receive the application as it does not disclose any reasonable cause for being entertained and proceeded to lodge it under Order XV Rule 5 of the Supreme Court Rules.
4. Having considered the matter in detail, we are of the opinion that the decision to lodge the application is correct in law.
5. Accordingly, the miscellaneous application is dismissed.
6. Pending application(s), if any, shall stand disposed of.
