The matter above mentioned was listed before the Ld. Registrar Court on 09.09.2016, when the Court was pleased to pass the following Order:-

"As per the tracking report, notice could not be served on the sole respondent and the postal remarks are 'door was locked' and 'unclaimed'. Hence fresh steps for the service of notice by usual mode to the said respondent shall be taken by the Ld.counsel for the petitioner within a period of three weeks. Dasti in addition is permitted to be served through the concerned Trial Court, the particulars of which shall be furnished by the Ld.counsel for the petitioner within the period provided above.

List the matter again on 21.10.2016."

It is submitted that as directed above, show cause notice to the sole respondent was issued through registered A.D. as well as Dasti. According to India post tracking report notice is delivered to New Delhi, GPO on sole respondent, notice to Trial Court is delivered to Nainital HO. Counsel for the petitioner has not filed affidavit with proof of dasti service through trial Court so far.

Service is not complete on sole respondent.

The matter above-mentioned is listed before the Court of Ld. Registrar with this Office Report.
