• (a) There are two Respondents in the Appeals. Respondent No. 2 is represented by Mrs. Rachana Joshi Issar, Advocate. Respondent No. 1 has been served with Notice at SLP stage but has not chosen to enter appearance.
• (b) Original Record has not been requisitioned from the High Court.
• (c) Not applicable.
• (d) Not applicable.
• (e) No application for substitution is pending.
• (f). The matters were placed before the Ld. Registrar's Court on 3rd September, 2015, when the following order was passed:-

"Among two common respondents herein, respondent No. 2 is already represented. Respondent No. 1 till date has not entered appearance, though was served at SLP stage itself. However, as on date the Ld. Advocate, Mr. R.K. Pandey, appearing on behalf of Mr. Kuldip Singh, Advocate-on-Record has appeared on its behalf. Time is requested for filing Vakalatnama. Be filed within four weeks. Statement of case, it any, be also filed within the time stipulated. List again on 23.11.2015."

It is submitted that Mr. R.K. Pandey, appearing on behalf of Mr. Kuldip Singh, Advocate on record for Respondent No. 1 has not filed Vakalatnama/appearance till date.

Neither Counsel for Appellant nor Counsel for the Respondents in the appeal have filed Statement of case. In terms of Rule 32, Sub Rule-2 of S.C.R. 2013, it is presumed that the appellant has adopted the list of dates/synopsis containing chronology of events as filed at the time of

presentation of petition for seeking special leave to appeal statement of case. If the Respondent has not filed statement of case within the stipulated time as provided in Sub Rule-1 of S.C.R. 2013, it is presumed that the respondent does not desire to lodge statement of case in the appeal.

(g) Not applicable.
